Tuesday’s argument in Ellingburg v. United States turned on whether the ex post facto clause of the Constitution applies to the Mandatory Victims Restitution Act. That clause bars imposing criminal punishments based on statutes not in force when the crime occurred. Because the MVRA was adopted after Holsey Ellingburg’s offense, it would violate the ex post facto clause to apply it to determine Ellingburg’s punishment if the restitution it requires is “criminal” under that clause. The argument was interesting because the government (which prosecuted Ellingburg) now agrees with Ellingburg that the MVRA cannot be applied to increase his punishment. So…

Backfilling the federal ESA AB 1319 is a good first step to responding to efforts to weaken the federal ESA I wrote this past spring about a proposal by the Trump Administration to eliminate the definition of harm in the regulations implementing the federal Endangered Species Act (ESA), which might eliminate protections from habitat modification for federally listed species.  I also noted three different steps California could do to backfill the federal ESA if such a regulatory change occurred to ensure that at least California species remained protected. The legislature has taken one of those steps.  AB 1319, just signed…

The Seventh Circuit Court of Appeals recently issued a significant ruling for employers facing Fair Labor Standards Act (FLSA) and Age Discrimination in Employment Act (ADEA) collective actions. In Richards v. Eli Lilly & Company, the court vacated and remanded a lower court’s decision to issue notice to a potential class, establishing a new, uniform standard for determining when court-authorized notice may be sent to potential plaintiffs. This decision directly impacts the initial stage of collective actions—the process of determining which employees are “similarly situated” and should receive official notice of the lawsuit. For employers, this is a welcome shift away…

Western biopharmaceutical companies are clamoring to ink deals with their Chinese counterparts. Over the last five years, the number of agreements struck by Chinese companies producing cancer…

Central banks brace for 2026 inflation risks, but lack consensus on how to tackle them. The single word that best captures the state of the global economy across every continent is uncertainty. Business leaders feel it acutely, but nowhere is it more pressing than in the deliberations of central bankers. Monetary authorities are operating in an environment where the trajectory of growth, trade, and inflation is increasingly difficult to predict, forcing them to rely on caution. With diverging approaches and contrasting trends, it is under this cloud of uncertainty that central banks around the world have been conducting policy, often…

Priya Kapur, the widow of late industrialist Sunjay Kapur, on Wednesday opposed an injunction plea filed by the children of Karisma Kapoor in the ongoing inheritance dispute, asserting that typographical errors cannot be grounds to question the validity of the will.   Appearing for Priya Kapur, Senior Advocate Rajiv Nayar described the suit of Karisma’s children as “hollow and frivolous,” arguing that it makes no substantive legal challenge to the will and does not include any formal plea for it to be set aside.    “If the will had simply been produced later, would that alone render…

Until recently, open support for Hamas in the United States was confined to the far left. The national chapter of Students for Justice in Palestine, which circulated talking points supporting the October 7 attacks, has lately declared on Instagram “DEATH TO COLLABORATORS.” But the notorious terrorist organization has found a new defender: President Donald Trump. On Sunday evening, a reporter asked the president about reports that Hamas is reestablishing its authority in the Gaza Strip by executing its rivals. Trump said that the group is merely cracking down on crime, for which it has American approval.“They do want to stop the…
